Short Answer
Ask your representative to send the underinsured motorist insurer a focused written status request that identifies the claim, confirms what was submitted, and asks what remains under review. The request should ask whether the insurer needs additional documents and when it expects to take its next step. Because negotiations do not automatically extend legal deadlines, the accident date and any policy-based deadlines should also be reviewed.
What Should a UIM Status Request Include?
A telephone call may produce an update, but a written request creates a clear record. If you have a lawyer or another authorized representative, the request should generally come from that person so communications remain organized.
The request should include:
- The injured person’s name, policy number, and claim number.
- The date of the car accident.
- The name and contact information of the assigned adjuster.
- The date the UIM demand or supporting documents were delivered.
- A list of any later medical records, bills, income-loss documents, or other updates sent to the insurer.
- A request for confirmation that the file is complete.
- A request identifying any missing information or unresolved coverage issue.
- A request for the current stage of review and the insurer’s next anticipated action.
It is usually more productive to ask specific questions than to send a message that only says, “Please provide an update.” A focused request makes it harder for important issues to remain unclear.
Why the Insurer May Still Be Reviewing the Claim
An underinsured motorist claim is a first-party insurance claim made under an applicable automobile policy. Even so, the UIM insurer may examine many of the same issues raised in the claim against the at-fault driver.
A typical review involves four overlapping subjects:
- Coverage: Whether the injured person qualifies as an insured and what UIM coverage applies.
- Fault: Whether the other driver was legally responsible for the collision.
- Damages: Whether the records support the claimed injuries, medical expenses, lost income, pain and suffering, and other claimed losses.
- Underlying insurance: Whether the at-fault driver’s applicable liability coverage has been paid, tendered, or otherwise exhausted as required.
North Carolina’s UIM framework appears in N.C. Gen. Stat. § 20-279.21. In general, the statute coordinates UIM coverage with the liability insurance available for the underinsured vehicle. The policy language, accident date, and policy issuance or renewal date can affect how the coverage operates.
Check Whether the Insurer Has All Current Documentation
A pending claim may stall because the adjuster is waiting for records or because new information has not been added to the file. Your representative can send an indexed package or updated document list rather than assuming the insurer has every item.
Useful materials may include:
- The crash report, photographs, witness information, and other evidence of fault.
- The applicable insurance declarations pages and relevant policy correspondence.
- The liability carrier’s coverage information, settlement offer, tender letter, or proof of payment.
- Medical records, bills, and visit summaries related to the accident.
- Documentation supporting claimed lost income or reduced earning ability.
- Receipts for accident-related out-of-pocket expenses.
- Prior demand letters and proof showing when they were delivered.
- Emails, letters, and notes of communications with each insurer.
If additional records or bills become available, they should be sent promptly and accurately. An insurer may say it could not reevaluate the claim if important new information was never provided.
Ask for the Reason Behind a Delay or Position
If the adjuster says the claim cannot move forward, your representative can ask for the reason in writing. The response should clarify whether the issue concerns coverage, fault, causation, damages, missing documents, the underlying liability claim, or another policy requirement.
If the insurer has denied the claim or made a compromise offer, the representative can request a reasonable written explanation tying the insurer’s position to the policy, known facts, and applicable law. If part of the claim is not disputed, the representative may also ask whether the insurer will issue any undisputed payment without requiring the injured person to give up the remaining disputed claim. Whether that request is available depends on the policy and circumstances.
A supervisor review may be appropriate when repeated, documented requests receive no meaningful response. Keep the tone factual and include a short communication timeline rather than relying on frustration or repeated informal calls.
Be Careful When the Liability Insurer Has Offered Its Limits
Do not sign a release with the at-fault driver or liability insurer without checking the UIM requirements. North Carolina law gives a UIM insurer important rights relating to the underlying claim.
When the UIM insurer receives written notice of a tentative settlement, the statute provides a 30-day period in which the UIM insurer may advance an amount equal to that settlement to preserve certain rights against the responsible driver. A status request in this situation should ask the insurer to confirm the date it received the settlement notice and whether it intends to advance the settlement amount or allow the settlement to proceed.
This is different from a general request for a claim update. The written notice must be handled carefully because settling without protecting the UIM insurer’s rights may create a coverage dispute.
Do Not Let Status Discussions Hide a Deadline
Insurance negotiations, unanswered emails, and an open claim file do not automatically stop a lawsuit deadline. N.C. Gen. Stat. § 1-52 provides a three-year period for many North Carolina personal injury actions, although the correct deadline depends on the claim and facts.
UIM policies may also contain notice, cooperation, lawsuit, service, or arbitration requirements. Arbitration may become available when the underlying liability coverage has been exhausted and the insured and UIM carrier disagree about legal responsibility or damages, but the policy must be reviewed before relying on that process. A demand for arbitration should not be assumed to preserve the underlying claim against the responsible driver.
Fault remains important as well. North Carolina permits a contributory negligence defense. If the insurer contends that the injured person’s conduct helped cause the collision, that position can create a serious issue for the UIM claim. The file should therefore contain evidence showing both what the other driver did wrong and why the injured person acted reasonably.
How This Applies to the Pending Claim
Here, the injured individual already has a pending UIM claim, and the representative wants the insurer to move it forward. The representative can send a dated written request that lists the materials previously submitted, asks the adjuster to confirm the file is complete, and requests a specific explanation of what remains unresolved.
The representative should also check whether the liability claim has reached a tentative settlement or exhaustion stage. If so, the request should address the statutory settlement-notice process rather than asking only for a general update. At the same time, the accident date and policy deadlines should be reviewed so the insurer’s delay does not cause the injured person to miss a required step.
